§ 1. General provisions

1. These terms set out the rules for using the website available at www.holisticaklinika.pl, hereinafter: "the Service".

2. The owner of the Service and the service provider within the meaning of the provisions on the provision of electronic services is Claudia Baluta-Górecka, conducting business under the name Claudia Baluta-Górecka — indywidualna specjalistyczna praktyka lekarska — HOLISTICA, with its registered office at ul. Pustynnej 53 lok. R, 93-479 Łódź, NIP: 7251793243, REGON: 101512578, hereinafter: "the Provider" or "the Controller".

3. The Terms apply to the use of the Service and the electronic services provided via it. The rules for providing healthcare services in the form of teleconsultations are set out in a separate Teleconsultation Terms and Conditions.

4. Before booking an appointment the User should read these Terms, the Teleconsultation Terms, the Privacy Policy and the GDPR information clause for patients.

§ 2. Definitions

1. Service — the website available at www.holisticaklinika.pl.

2. User — a person using the Service.

3. Patient — a person using or intending to use healthcare services offered by the practice.

4. Electronic services — services provided electronically via the Service, in particular provision of content, a contact form, information about services and the possibility to book an appointment, if the functionality is active.

5. Booking — the process of arranging an appointment via the Service, by telephone, e-mail, form, calendar or external platform, in particular ZnanyLekarz.

§ 3. Types and scope of services provided electronically

1. The following electronic services may be provided via the Service:

   a) providing information about the practice, the physician and the services offered;

   b) providing educational or informational content;

   c) enabling contact with the practice using contact details or a contact form, if the form is available;

   d) enabling appointment booking or redirecting to a booking tool;

   e) enabling online payment, if such functionality is active;

   f) sending organizational messages related to bookings, in particular appointment confirmations, organizational information and patient documents.

2. Use of the Service is free of charge, except for paid healthcare services or other services indicated in the price list.

3. Content posted on the Service is for informational and educational purposes. It does not constitute individual medical advice or diagnosis.

§ 4. Technical conditions for using the Service

1. To use the Service you need a device with Internet access, an up-to-date web browser and an active e-mail account if the User uses a form or booking requiring e-mail contact.

2. The User should use the Service in a manner consistent with the law, good manners and these Terms.

3. The User may not submit unlawful content via the Service, infringing third party rights, containing malicious software or disrupting the Service.

§ 5. Appointment bookings

1. Appointment booking may be done via a form or calendar available on the Service, by telephone, e-mail or via the ZnanyLekarz platform if such booking method is active.

2. Booking requires providing data necessary to schedule the appointment, for organizational contact and patient identification in accordance with legal requirements and the practice's documentation.

3. Booking confirmation may be sent electronically, by telephone, SMS or via the booking platform, depending on the registration channel.

4. If booking is carried out via an external platform, in particular ZnanyLekarz, the terms and conditions and rules of that platform may also apply.

5. Rules for providing teleconsultations, patient identity verification, technical conditions for teleconsultation, appointment cancellations and special rules for minor patients are set out in a separate Teleconsultation Terms and Conditions.

6. Rules for cancelling an appointment, changing its date and possible fees related to failure to cancel on time should be provided to the patient before booking, in particular in the Teleconsultation Terms, price list or information given at registration.

§ 6. Payments

1. Service prices are provided on the Service, under "Services", "Price list" or in information given to the patient before booking.

2. Payment for services may be made by bank transfer, BLIK, payment card, via an online payment system or in another way indicated to the patient before the appointment.

3. If payment is made via an external payment operator, the operator's terms and rules may also apply.

4. At the patient's request a receipt, invoice or other relevant billing document may be issued in accordance with applicable regulations.

§ 7. Liability

1. The Controller endeavors to ensure that information posted on the Service is up-to-date and reliable.

2. The Controller is not liable for consequences of using informational content on the Service as a substitute for individual medical consultation.

3. The Controller is not liable for interruptions in access to the Service due to technical reasons, maintenance, failures, force majeure or causes beyond the Controller's control.

4. The Controller is not liable for the operation of external platforms, payment systems, telecom operators or other providers that the User uses independently of the Service.

§ 8. Copyright

1. Content posted on the Service, including texts, graphics, photos, educational materials and site layout, are the property of the Controller or used under appropriate licenses or consents.

2. Copying, distributing, modifying or using content from the Service beyond permitted use requires the prior consent of the Controller, unless law provides otherwise.

§ 9. Complaints about the Service

1. Complaints regarding the operation of the Service or electronic services may be submitted electronically to: kontakt@holisticaklinika.pl or another current contact address indicated on the Service.

2. A complaint should include contact details enabling communication with the complainant and a description of the problem.

3. Complaints will be processed within 14 days of receipt, unless the nature of the matter requires a longer period. In such case the complainant will be informed of the reason for the delay.

4. Complaints concerning healthcare services, medical records, patient rights or the treatment process are handled in accordance with applicable medical law and procedures in force at the practice.

§ 10. Personal data and cookies

1. The rules for processing personal data of Users and patients are set out in the Privacy Policy and the GDPR information clause for patients.

2. The rules for the use of cookies or similar technologies are set out in the Cookies Policy available on the Service.

§ 11. Final provisions

1. The Controller reserves the right to change the Terms for important reasons, in particular changes in law, changes in Service functionality, changes in the method of providing electronic services or changes in the Controller's data.

2. The current version of the Terms is published on the Service.

3. Matters not regulated by the Terms are governed by Polish law.

4. Any disputes arising from use of the Service will be resolved by the competent court in accordance with applicable law.
